Welcome to Boier Timepieces. By accessing or using our website bolertimepieces.co (the "Site") and purchasing our products, you agree to be bound by the following Terms of Service ("Terms"). Please read them carefully before making a purchase.

These Terms constitute a legally binding agreement between you and Boier Timepieces.

1. General Conditions & Eligibility

  • By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or country of residence.

  • We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion for any reason at any time, including but not limited to suspected fraudulent activity or violations of these Terms.

  • You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Site or its content without our express written permission.

2. Multi-Currency, Pricing, and Taxes

  • Currencies: Prices are dynamically displayed and processed in your local currency (USD, CAD, GBP, AUD, or NZD) via Shopify Payments, based on your shipping location.

  • Price Adjustments: We reserve the right to modify prices, descriptions, and availability of products at any time without prior notice.

  • Taxes & Duties: For domestic orders (e.g., UK), applicable local taxes are included at checkout. For international orders, customers are responsible for any local import duties, customs fees, or GST/VAT levied by their destination country's customs authority.

  • Product Representation: Product images are for illustrative purposes. While we strive to display colors and details as accurately as possible, we cannot guarantee that your device's screen will perfectly reflect the actual color of the timepiece.

3. Order Acceptance and Payment Security

  • Payment Gateways: All payments are securely processed through our authorized third-party providers (Shopify Payments, Stripe, and Apple Pay/PayPal where available). We do not store your credit card information.

  • Order Verification: Receipt of an order confirmation email does not signify our acceptance of your order. In accordance with Stripe fraud prevention guidelines, we reserve the right to accept, decline, or limit your order for any reason, including payment verification failures or stock discrepancies. If we cancel an order after your payment has been processed, a full refund will be automatically issued to your original payment method.

4. Shipping, Delivery, and Risk of Loss

  • Geographic Scope: We ship to the United Kingdom, United States, Canada, Australia, and New Zealand.

  • Shipping Terms: Delivery timeframes provided at checkout are estimates and are not legally binding guarantees. Boier Timepieces is not liable for transit delays caused by customs clearance, extreme weather, or courier-specific disruptions.

  • Risk of Loss: All items purchased from Boier Timepieces are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. However, all our shipments are fully insured to protect your purchase against transit loss or damage.

5. Returns, Refunds, and Statutory Consumer Rights

  • Return Window: We offer a 45-day return window from the date of delivery, subject to the conditions outlined in our Refund Policy.

  • International Statutory Protections:

    • UK Customers: Your rights under the Consumer Contracts Regulations are fully respected, including your 14-day statutory right to cancel.

    • Australian & New Zealand Customers: Our products come with statutory consumer guarantees under the Australian Consumer Law (ACL) and the New Zealand Consumer Guarantees Act (CGA). Nothing in these Terms excludes, restricts, or modifies any non-excludable legal rights or remedies you have under these laws.

6. 24-Month Limited Warranty

  • All Boier Timepieces watches are backed by a 24-month limited warranty from the date of purchase.

  • What is Covered: This warranty strictly covers internal manufacturing defects of the watch movement, hands, and dial.

  • What is NOT Covered: The warranty does not cover:

    • Damage resulting from improper handling, accidents, normal wear and tear (e.g., scratches on the crystal, case, or strap).

    • Water damage unless the watch is explicitly rated for the depth experienced and instructions were followed.

    • Theft, loss, or unauthorized repairs/modifications conducted by third parties.

7. Intellectual Property

All content hosted on this Site—including but not limited to text, graphics, logos, brand names, product photography, and website layout—is the exclusive property of Boier Timepieces and is protected by international copyright, trademark, and intellectual property laws. Any unauthorized commercial use is strictly prohibited. 

Boier Timepieces strictly designs and sources unbranded, or independently branded timepieces. We do not sell counterfeit goods, replicas, or unauthorized homages. Any similarity to high-end luxury brands is purely coincidental in standard horological design elements.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Boier Timepieces, its directors, or employees shall not be liable for any indirect, incidental, punitive, or consequential damages (including loss of profits, data, or use) arising out of your use of the website or the performance of our products, even if advised of the possibility of such damages.

9. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of England and Wales, without prejudice to any mandatory consumer protection laws applicable in your country of residence.

10. Changes to These Terms

We reserve the right to update, modify, or replace any part of these Terms at our discretion by posting updates to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
